Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Kinsight Secure mobile application (“App,” “Service”), operated by Stillwater Rise Group LLC (“Company,” “we,” “us,” “our”), a Tennessee limited liability company. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
This Service is directed to users in the United States. We take measures to limit availability to the United States, and our infrastructure is hosted in the United States. We may expand availability in the future.
Please read Section 9 carefully — the App is NOT a substitute for calling 911 or your local emergency services.
1. Acceptance of Terms
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms are a legally binding agreement between you and Stillwater Rise Group LLC. We may update these Terms as described in Section 14.
2. Eligibility and Family Members
You must be at least eighteen (18) years old to create an account. By creating an account, you represent that you are at least 18 and have the legal capacity to enter into these Terms.
Kinsight Secure is a family-safety service, and family groups may include children, including children under 13, who are added by a parent or guardian. A child does not create or hold an account and is not asked for an email address. When you add a child to your family group, you must affirm that you are that child's parent or legal guardian, and that affirmation is your consent to our collection and processing of the limited child data described in the Privacy Policy (“Children and Families”). You are responsible for all activity associated with members you add, including minors, and for having the authority to add them.
3. Account Creation and Security
3.1 Registration. Provide accurate, complete, current information and keep it updated.
3.2 Passwordless Authentication. The Service uses passwordless authentication via biometric verification and device-bound cryptographic keys. You are responsible for the security of devices linked to your account and for all activity under your account.
3.3 Account Security. Maintain physical security of your devices; notify us promptly of suspected unauthorized access; do not share device access with unauthorized persons; do not attempt to access another user's account. We are not liable for loss arising from your failure to maintain account security.
4. Description of Service
Kinsight Secure provides location sharing within user-defined family groups, geofencing with configurable alerts, SOS alerts for emergencies, and secure messaging between family members.
4.1 Encryption architecture. Your location, messages, and SOS details are end-to-end encrypted: encrypted on your device before transmission and at rest on your device, and relayed by our servers as ciphertext they cannot read. Only members of your family group can decrypt that content. Certain operational data is readable by our servers (for example your email, the display names you set, and your family structure), and certain features involve third-party data flows from your device (for example map and place-search requests to our maps provider). The Privacy Policy describes precisely what we can and cannot read.
4.2 Data sharing within the family. Content shared through the Service is accessible to the members of your user-defined family group. You control who is in your family group and what you share.
5. Subscription and Payment Terms
5.1 Plans. Kin — $8.99/month (up to 2 members); Family — $14.99/month (up to 4 members); Household — $24.99/month (up to 8 members). For groups larger than 8, contact support@kinsightsecure.com. Business plans by direct negotiation. Pricing is subject to change with reasonable advance notice to existing subscribers.
5.2 Payment Processing. Payments are processed by Stripe, Inc. By subscribing you agree to Stripe's terms. We do not store your full payment card information.
5.3 Billing and Renewal. Subscriptions auto-renew at the end of each billing period unless canceled before renewal. You authorize recurring charges to your payment method.
5.4 Cancellation and Refunds. Cancel anytime in the App or by contacting us; cancellation takes effect at the end of the current period. We do not provide prorated refunds for partial periods. Other refund requests are evaluated case-by-case at our discretion.
5.5 Failed Payments. If payment fails we may retry; if it cannot be collected after reasonable attempts, paid access may be suspended or terminated.
6. Acceptable Use
You agree not to use the Service to: violate any law; stalk, harass, threaten, intimidate, or monitor any person without their knowledge and consent; track any individual who has not consented, except for a minor child under your legal guardianship; transmit unlawful or objectionable content; disrupt the Service or its networks; gain unauthorized access to the Service, accounts, or systems; reverse engineer the App except as permitted by law; use the Service for unauthorized commercial purposes; use bots or scripts; or circumvent security features. We may investigate and act on violations, including suspending or terminating accounts and reporting to law enforcement.
7. Intellectual Property
7.1 Ownership. The Service and all underlying technology are owned by Stillwater Rise Group LLC and protected by US and international IP laws.
7.2 Patent Pending. The technology underlying Kinsight Secure is the subject of a pending United States patent application; all rights reserved.
7.3 License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control for personal, non-commercial use.
7.4 Restrictions. Do not copy, modify, distribute, sublicense, sell, lease, or transfer the App; do not remove proprietary notices; do not use our trademarks without written consent.
7.5 User Data. You retain ownership of data you create. You grant us a limited license to process it solely to provide and improve the Service, subject to our encryption architecture and the Privacy Policy.
8. Privacy
Your use of the Service is governed by our Privacy Policy, incorporated by reference. For end-to-end-encrypted content (location, messages, SOS details), we have no ability to read or decrypt the content shared within your family groups. 9. Emergency Features Disclaimer
IMPORTANT — PLEASE READ CAREFULLY. Kinsight Secure includes SOS alert and other emergency-related features. These are supplementary tools and ARE NOT A SUBSTITUTE FOR CALLING 911 OR OTHER EMERGENCY SERVICES. You acknowledge and agree:
- The Service is not an emergency service provider. SOS sends notifications to members of your family group only. It does not contact police, fire, medical, or any emergency service.
- Always call 911 (or your local emergency number) first. Do not rely on the App as your primary or sole means of requesting emergency assistance.
- We make no guarantee that SOS alerts or emergency features will be delivered successfully, timely, or at all. Delivery depends on connectivity, device status, and factors beyond our control.
- We are not liable for any injury, death, property damage, or other loss resulting from reliance on the SOS feature or any feature in an emergency.
- Location accuracy is not guaranteed and may be inaccurate, delayed, or unavailable.
BY USING THE EMERGENCY FEATURES, YOU EXPRESSLY ACKNOWLEDGE AND ACCEPT THESE LIMITATIONS.
10. Disclaimers
10.1 “As Is.” THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10.2 No Guarantee of Availability. We do not warrant the Service will be uninterrupted, timely, secure, or error-free.
10.3 Third-Party Services. The Service integrates with third-party services (for example, Stripe for payments, the maps provider for mapping, and the operating system for biometrics). We are not responsible for their availability, accuracy, or reliability.
10.4 App Distribution. The App is distributed via official app stores and/or direct administrator install. Installing applications from sources outside official app stores may present additional security considerations, and you assume any associated risk. Platform terms from app stores may also apply.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- IN NO EVENT SHALL STILLWATER RISE GROUP LLC OR ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TWO HUNDRED FIFTY DOLLARS ($250.00).
- THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Indemnification
You agree to indemnify and hold harmless Stillwater Rise Group LLC and its officers, directors, members, employees, and agents from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: your use of the Service; your violation of these Terms; your violation of a third party's intellectual property, privacy, or other right arising from your conduct; your violation of law; content or data you transmit; or any misuse of emergency features, including failure to contact emergency services when needed.
13. Termination
13.1 By You. Terminate anytime via the App or by contacting us; access continues through the end of the current billing period.
13.2 By Us. We may suspend or terminate your account at any time, with or without cause or notice, including for violations of these Terms or the Acceptable Use section, harmful conduct, extended inactivity, or non-payment.
13.3 Effect. On termination your license ends; you must delete all copies of the App; we may delete your account data per the Privacy Policy and applicable retention requirements (a 30-day scheduled erasure applies to account deletion; beta/NDA acceptance records are retained as a legal record). Sections that by their nature survive — including 7, 10, 11, 12, and 15 — survive termination.
14. Changes to Terms
We may modify these Terms. For material changes we will: update the Effective Date; notify you through the App, by email, or other reasonable means; and provide at least thirty (30) days' notice before material changes take effect. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and cancel.
15. Governing Law and Dispute Resolution
15.1 Governing Law. These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
15.2 Informal Resolution First. Before filing a claim, you agree to contact us at support@kinsightsecure.com and try to resolve the dispute informally. We will try to do the same. Most disputes can be resolved this way. If the dispute is not resolved within sixty (60) days, either party may proceed to court.
15.3 Courts. Any dispute arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved in the state or federal courts located in Tennessee, and both parties consent to the jurisdiction and venue of those courts. You may also bring a qualifying individual claim in small-claims court.
15.4 No Forced Arbitration, No Class-Action Waiver. These Terms do not require you to arbitrate disputes and do not waive your right to bring or participate in a class action. We believe you should keep your day in court.
16. General Provisions
16.1 Entire Agreement. These Terms and the Privacy Policy are the entire agreement and supersede prior agreements.
16.2 Severability. If a provision is invalid, the rest remains in effect; the invalid provision is modified to the minimum extent necessary.
16.3 Waiver. Failure to enforce a provision is not a waiver; waivers must be in writing.
16.4 Assignment. You may not assign these Terms without our consent; we may assign without restriction.
16.5 Force Majeure. We are not liable for failures due to causes beyond our reasonable control.
16.6 Notices. To you: through the App, by email, or other reasonable means. To us: the contact in Section 17.
